Bombay High Court: Orders night patrolling to curb noise pollution

To curb the noise pollution in Goa, the Bombay High Court at Goa has directed the sub division night duty officers, beat staff and the local intelligence bureau to carry out continuous night patrolling.

The division Bench comprised of Justices M S Jawalkar and Revati Mohite who directed to set up a telephone line 112 to note the complaints on noise pollution. Also, a record of all the complaints is to be maintained by the control room operators and it shall be forwarded to the police station. The District Magistrate shall be reported with the cases of violations.

These directions were given after hearing a Public Interest Litigation filed by Sagardeep Sirsaikar. He had requested to implement the noise pollution rules in Anjuna-Vagator.

The High Court stated, “The police shall immediately carry out inspection if the allegation is found to be correct, appropriate steps are required to be taken to stop such noise pollution, register FIR and investigate and proceed against the violators in accordance with the law.”

The provisions of the Noise Pollution (Regulation and Control) Rules 2000 and the Environment Protection Act and Rules will be used to take action against the ones who violate the rules by the District Magistrate.

Further, Advocates Gaurish Malik and Nigel da Costa Frias informed the Court that no action was being taken despite filing complaints and that loud music was being played beyond the permissible limit and for long hours until early morning. Evidences like the videos of parties were submitted to support their point.

Though the petition requested the implementation of rules in the Chapora, Anjuna and Vagator regions; the directions have been issued to implement the rules across the state by the High Court.
