The Supreme Court allowed time until 22nd October to the Indian Army and Centre to resolve the issue of grant of Permanent Commission to 72 Women Short Service Commission Officers against whom there is no issue of disciplinary or vigilance clearance.

The Court asked Additional Solicitor General (ASG) Sanjay Jain for the Centre and Senior Advocate R. Balasubramanian for the Army to look personally into the March Judgement.

The Judgement said, “If the women officers meet the cut-off of 60% and clear medical fitness criteria and have received disciplinary and vigilance clearance, shall be entitled to permanent commission.”

Justice D Y Chandrachud and Justice B V Nagarathna were hearing the Contempt of Petition filed by the 72 Women Officers of the Indian Army who were denied Permanent Commission in violation of the March Judgement.

The Petitioners argued that their claim was rejected based on a September 2020 assessment by the Selection Board that allegedly found charges against the Petitioners for being incompetent for Permanent Commission.

The Indian Army sought clarification from the Top Court on the grant of Permanent Commission to Women Officers who failed on criterion, and asked whether the March ruling meant to grant Commission even after the failure of the test.

The Petitioner’s Senior Advocates submitted that Supreme Court in August dismissed the Miscellaneous Application for clarification of the abovementioned claim.
