‘The Unity of India is not a Reed that can bend to Slogans,’ Allahabad High Court in granting Bail to students in the T20 World Cup Case

The Allahabad High Court stated in a Judgement granted Bail to three Kashmiri students Jailed on Sedition Charges for their Statements during the India-Pakistan T20 World Cup match in October last year that the Country’s foundations are enduring and that Unity will not bow to empty slogans.

Arsheed Yusuf, Inayat Altaf Sheikh, and Showkat Ahmed Ganai have been held in the Agra District Jail for the last five months after being detained on October 26 for Statements made following Pakistan’s Triumph over India. The three were studying at an engineering college in Agra as part of the PM Special Scholarship Scheme.

The fact that individuals travelled considerable distances inside the country for education was something to appreciate, according to the Court.

“Students freely travelling to all regions of the nation in search of knowledge is a real celebration of India’s variety and a vibrant demonstration of India’s togetherness.”

It is the people of the host State’s responsibility to provide conditions that allow visiting academics to understand and embody our Nation’s Constitutional ideals. It is also the responsibility of young scholars to learn and uphold such principles.”

The Court emphasised the “constancy of Indian principles and perpetuity of Indian people” by using three lines from poet Alama Iqbal’s poem “Saare Jahan Se Acha Hindustan Hamara.”

The Judge further stated that the Court is directly hearing the Bail application. “There are extraordinary conditions that justify doing so.”

It is reported that the Agra District Bar Association approved a resolution Prohibiting the Applicants from receiving Legal Aid. The applicants were also attacked in Agra’s District Court.

“Lawyers have an Oath imprinted in their conscience to help the cause of Law under all circumstances and to serve Justice to those who seek it at all times,” the Court stated.

For Allegedly sending WhatsApp messages “against the Country” after the cricket match, the students were charged under Indian Penal Code Sections 124 A (sedition), 153-A (promoting enmity between different groups), 505 (1)(B) (with intent to cause, or which is likely to cause, fear or alarm to the public, or to any section of the public), and 66-F of the Information Technology Act. The Charge-sheet was submitted in accordance with the same Indian Penal Court Provisions.
