Supreme Court restores KCOCA charges in Gauri Lankesh Murder Case

The Supreme Court reinstated the charges against accused Mohan Nayak in the Gauri Lankesh Murder Case under the Karnataka Control of Organized Crimes Act (KCOCA) on Thursday.

A Bench of Justice AM Khanwilkar, Justice Dinesh Maheshwari, and Justice CT Ravikumar upheld a ruling of the Karnataka High Court that had overturned the KCOCA charges against Mohan Nayak, after hearing an Appeal filed by Gauri Lankesh’s sister Kavita Lankesh.

The operative portion of the ruling was delivered by the bench this morning.  A detailed copy of the verdict is awaited. 

After hearing extensive submissions from Senior Advocate Huzefa Ahmadi, representing Kavitha Lankesh, and Advocate Basava Prabhu S Patil, representing accused Mohan Nayak, the Supreme Court reserved the Orders on September 21, 2021.

Senior Advocate Huzefa Ahmadi, appearing on behalf of the petitioner, stated before the Court that the short question that arose for consideration before the Court was about the approval that was granted under Section 24(1) to invoke provisions of the KCOCA Act and the cognisance taken thereon, as well as the charge sheet filed.

The Lawyer went on to say that the High Court had decided that the Act was not applicable in the case of the Accused, but that the Court had made an error in concluding that KCOCA was not applicable at all.
