Supreme Court instructs meeting between Central and Delhi Governments to improve security in Tihar Jail

On Thursday, the Supreme Court in the Case of Bhupinder Singh vs Unitech Ltd instructed the Central and Delhi governments to hold a meeting to make sure that the Delhi Police Commissioner’s recommendations to improve security inside Tihar Jail are implemented in a systematic manner.

After it was found that the Accused Chandra brothers in the Unitech Case were engaging in unlawful activities inside the Jail with the assistance of Jail Officers, a Bench of Justices DY Chandrachud and MR Shah took the step of addressing Jail security degradation.

The Court ordered that a meeting should be held within a week between the Ministry of Home Affairs, the Director General of Prisons at Tihar Jail, and the Delhi Chief Secretary to decide how to enact the Police Commissioner’s report.

The Bench was notified by the Ministry of Home Affairs (MHA) that the Delhi Government has yet to take steps to establish and implement the Commissioner’s recommendations. The MHA also stated that “Prison” is a subject of the State.

The Court determined that the “changing of liability between MHA, the DG of Prisons, and the Delhi Government must be addressed through effective coordination and expeditious decision making.”

Hence, it was ordered by the Court that a meeting should be held within one week of today between the following-

“ A Secretary-level officer of the MHA, the DG of Prisons at Tihar Jail and the Chief Secretary of Delhi Government.”

The installation of cellphone jammers, full-body X-Ray machines, and CCTV cameras are among the recommendations suggested by the Police Commissioner.

The Case will be heard again on February 17, 2022.
