Supreme Court cancels Bail of Accused of Conspiracy in Honour Killing Case

Supreme Court of India has refused Bail to an accused person for the conspiracy of murder in the Honour Killing Case, granted by the Rajasthan High Court in its Order on the matter.

A petition by the victim’s wife was filed in the Supreme Court challenging the bail granted to the accused, Mukesh Chaudhary, for the murder of his brother-in-law, who was eventually shot point-blank in front of his pregnant wife by a hired gun in an alleged case of honour killing.

The victim, Amit Nair was from Kerala and his wife, Mamta Nair from Rajasthan. The woman had married a Malayali man against the wishes of her family.

Amit Nair was brutally killed over the issue of intercaste marriage. Mamta asserted that “The plot to kill her husband was hatched by her parents and her brother along with other co-conspirators hired to carry out the act.”

The order of refusing bail was passed by the bench comprising of Chief Justice NV Ramana, Justice AS Bopanna and Justice Hrishikesh Roy.

The accused is tried for offences provisioned under Sections 302, 452 and 120B of the Indian Penal Code (IPC), for house-trespass and murder and its conspiracy.

“We are of the view that the order passed by the High Court should be set aside. We direct the respondent to surrender before the District Judge. We are of the considered view, the bail granted to the respondent by the Rajasthan High Court is not sustainable. A trial should be expedited within one year,” the Court ordered.

“The High Court ignored the substantial evidence obtained in the case while granting Chaudhary bail. Further, the High Court failed to consider the fear and terror being experienced about my safety, and the safety of my child and mother-in-law,” Mamta states in her plea.
