Supreme Court Agreed to Hear Petition Regarding Andhra Pradesh Reorganisation Act

There are several Petitions filed and one of the Petitioners was Kiran Reddy, former Chief Minister of Andhra Pradesh regarding the Bifurcation of the State and passing of the Bill in both the Houses in the “Controversial Manner”.

Advocate Prashant Bhushan representing the Petitioner in the Case asserted that the Petition was filed in 2014 and it was pending from then although now the matter of regarding the Bifurcation of Andhra Pradesh had become pointless but there are other matters also in the Petition which are important to hear.

“This Case is regarding the Bifurcation of Andhra Pradesh. That part may have become infructuous but there are other questions which are involved regarding the Bifurcation of States. Please list it someday,” Prashant Bhushan said.

The Bench comprised of Chief Justice N V Ramana, Justice Krishna Murari and Justice Hima Kohli stated “We will see” on Friday.

On February 18, 2014; Lok Sabha passed the Andhra Pradesh Reorganisation Act, 2014 and Rajya Sabha passed it on February 20.

On March 1, 2014 President Pranab Mukherjee gave his Assent.

The contention made by the Petitioner is it was Unconstitutional and Illegal Bifurcation of the State.

They had made an Objection that how Centre can decide to Bifurcate a State when State Legislative Assembly has rejected the proposal of Bifurcation presented by the Parliament.

Although the State has Bifurcated in 2014 but Supreme Court has approved to hear the Petition regarding Andhra Pradesh Reorganisation Act, 2014.
