Six men suspected of Unlawful Assembly and Arson acquitted by Court

Six people accused of Rioting, Public Disorder and Arson in the Jyoti Nagar area during the northeast Delhi riots on February 2020 have been acquitted by Delhi Court on Tuesday. It was ruling that there was insufficient evidence to convict any of the defendants.

On February 25, 2020, Additional Sessions Judge Amitabh Rawat released Amir, Saddam, Mohammad Rahis, Amir, Akram, and Wasim in the Case of ransacking and burning of two tractors pertaining to Shahid and Firoz Khan, as well as some others in the parking lot behind Ambedkar College in Kardam Puri.

According to the court, the only incriminating material against the six accused was the disclosure statements they made following their arrest. It further stated that “disclosure statement, by itself, has no value in the eyes of law.”

As per the Judge, there is no witness, public or police, who recognised the accused while they were committing the crimes. He also stated that any incriminating evidence against the accused persons has not been presented in the claims of the Special Public Prosecutor for the Police.

The Judge stated in his six-page order that as per the details of the whole charge-sheet, including the annexures, he is of the view that there is no worthwhile content to frame charges against any of the people accused of crimes in respect of the offences covered in this case. Thus, all six accused persons, Amir S/o Nafis, Amir S/o Abrar, Saddam, Mohd. Rahis, Akram, and Wasim, are released for all offences punishable under Sections 147 (Rioting), 148, 427 (Damage), 436 (Arson), and 149 (Unlawful Assembly) of the Indian Penal Code.

On December 7, four men in a riot case were exonerated by a city Court saying it is “utterly loath” to put any trust in the testimony of two prosecution witnesses who were a constable and a head constable.
