In the case of Henna Subbha and Ors vs. State of Sikkim, the scheme of “One Family One Government Job” was upheld by the Sikkim High Court stating that it is beneficiary for the citizens and there is no doubt concerning the bonafides of this scheme.

Under this Scheme, a Division Bench of Chief Justice Biswanat Somader and Minakshi Madan Rai observed that over 13,000 citizens got jobs initiated by former Chief Minister Pawan Chamling.

Plenty of petitions were submitted before the Court by highly qualified but jobless youngsters who opposed to the State Government’s “One Family, One Job” policy decision, which they said did not conform with any legislative provision.

In response to their Petition, Umesh Sunam, a Joint Secretary at the Government of Sikkim’s Department of Personnel, Administrative Reforms, and Training, filed an affidavit claiming that the scheme was launched by the former Chief Minister (CM) after he completed a tour of all 31 constituencies in the State.

In response to her request, Umesh Sunam filed an affidavit that the program was initiated by the former Chief Minister (CM) after completing tours of all 31 constituencies in the state.

Thousands of citizen applications were received, but they could not be evaluated, therefore the then-CM decided to hold walk-in interviews for the open positions, according to the Court.

As a result, according to the Affidavit, the then-government chose to accept only applications from candidates who did not have any family members working for the government, which led to the creation of the current plan in issue.
