SC Stays Delhi HC Order to Register FIR Against BJP’s Shahnawaz Hussain in 2018 Rape Case

The Supreme Court stayed the proceedings regarding a 2018 rape case against BJP Leader Syed Shahnawaz Hussain who had approached the apex court challenging the the order by the Delhi HC which had directed the registration of an FIR against him.

The bench comprising of Justices Sudhansu Dhulia and S Ravindra Bhat has granted liberty to the complainant to file objections and also to approach the police in order to avail protection due to alleged threat and assault.

The background of the case is that a complaint was filed against BJP leader Shahnawaz Hussain under Sections 376, 328, 506 and 120B IPC.

The Delhi High Court observed that the complaint sent to the Commissioner of Police clearly disclosed the commission of the cognizable offence of rape.

While noting the “complete reluctance” on the part of city police to register the FIR, Justice Asha Menon had directed the investigation in the matter be completed.

Hence, Hussain moved the SC against the Delhi HC order.
