SC states ‘Distrust between institutions, very distressing’

The Supreme Court during the hearing of the Extortion Case against the former Mumbai Police Chief Param Bir Singh disclosed its concern over the disrupting trust in the top institutions.

The Supreme Court in the previous hearing had Ordered that Singh will not be Arrested in any of the Cases registered against him till their further directions.

Justice SK Kaul stated that, “It’s a disturbing scenario. What do we say that the head of the police force has no faith in that force? We have given you enough protection. Not giving you anymore”.

This concern was raised when the Maharashtra Government showed their denial in assigning this Case to the Central Bureau of Investigation (CBI) for probing into the matter after Singh’s letter Alleged former Maharashtra Home Minister Anil Deshmukh as one of the Accused.

Senior Advocate Darius Khambata appearing for the Maharashtra Government stated that it would be unfair to transfer this Case to the CBI when the CBI Chief is the Witness for the Case pertaining to Mr. Deshmukh.

Puneet Bali, the Advocate representing Param Bir Singh informed the Court that the First Information Reports (FIRs) against the top cop were made to deliberately hinder the CBI Investigation.

However, the Solicitor General Tushar Mehta on behalf of the CBI informed the Court that the Agency is advancing the Investigation as per the instructions and directions provided by the High Court and expressed concerns that the Maharashtra Government’s decisions should not harm the CBI Investigation.

The Supreme Court to all the submissions and arguments expressed its distress on the point where the “institutions are doubting each other”.

While Ordering the Maharashtra Government to respond to the CBI in three weeks, Justice Kaul stated, “What can we do if institutions start expressing such doubt against each other? Disturbing scenario. We want the state government to also take steps. We will have to see whether they are able to take the probe further or not”.

The Apex Court has also Ordered the top cop to give his assistance in the probe whenever necessary.
