The Supreme Court disagreed with a man’s defense against the charge of cruelty and refused to grant him an anticipatory bail.
The man alleged that her wife had posted around 300 tik tok videos showing “obscene content”. He also denied being cruel to his wife.
However, the Apex Court Bench headed by Chief Justice SA Bobde disregarded his contentions and held that a wife’s obscenity cannot be a reason for her husband’s cruelty.
You are a cruel man. You have exhibited cruelty towards your wife,” the Court said. If she has done that and you cannot get along with her, you can divorce her. There is no need to resort to cruelty on her,” it added.
The man’s lawyer complained that FIRs are always one-sided and that there has been no ‘joint’ FIR filed together by both parties (victim and accused).
The Bench replied to the above comment and dismissed the case.
