SC Refers BCCI’s Plea to the Bench Led by Justice Chandrachud

A Justice DY Chandrachud led Supreme Court Bench will hear cases involving the India’s Board of Cricket Control (“BCCI”). Applications to amend the BCCI’s constitution have now been moved.

The original order in the BCCI case was passed in August 2018 by a Bench comprised of the then-CJI Dipak Misra, Justice AM Khanwilkar, and Justice Chandrachud, CJI NV Ramana noted when the subject was brought before a court chaired by the Chief Justice of India on Wednesday.

Only Justice Chandrachud is still remaining on the Supreme Court out of the members of the previous Bench; the other two have retired. In light of this, the CJI told the Solicitor General of India that a Bench led by Justice Chandrachud.

According to the recommendations made by the committee by retired Justice RM Lodha, the BCCI had drafted a constitution that mandated an office holder to take a three-year break after serving in that capacity for six years, either at the state level or the BCCI. The BCCI had pushed for the abolition of the cooling-off period for office holders like the President and Secretary in the amendment, allowing the current President Saurav Ganguly and Secretary Jay Shah to remain in their positions despite having served six years in their respective state associations.

Senior Advocate Maninder Singh was appointed by the Supreme Court on July 21 to serve as an amicus curiae in the matter because Justice PS Narasimha, the previous amicus, is now a Supreme Court judge.
