SC directs WB Assembly Speaker to Decide Mukul Roy’s Disqualification Petition

The Supreme Court anticipated that West Bengal Assembly Speaker Biman Banerjee might determine on the Plea for Disqualification of Mukul Roy as a member of the House alleging that he has revolted to the Trinamool Congress (TMC) after being elected on a Bharatiya Janata Party (BJP) ticket.

A Bench comprising of Justices L Nageswara and Hima Kohli adjudicated the Court and were hearing Appeals registered by the Assembly Speaker and the Secretary and the Returning Officer of West Bengal Assembly against the Calcutta High Court’s Notification.

On September 28, the High Court had demanded the Speaker to give a Verdict on the Petition for Disqualification against Roy by October 7.

Further Senior Advocate A M Singhvi representing Banerjee had submitted in the Apex Court, stating that the Disqualification Petition is scheduled for hearing on December 21 before the Speaker.

The Apex Court did not pass an Order on the Appeals.

Furthermore, the Bench stated “We hope that the Speaker proceeds with the Matter on December 21, 2021 and decides the same in accordance with law.”

The Court adjourned the case for a further Hearing in January next year.

The case came into light when leader of the Opposition Suvendu Adhikari had on June 17 had filed the Petition before the Speaker pleading Disqualification of Roy as a member of the Assembly, alleging that he had revolted to the TMC.

BJP MLA of the State, Ambika Roy, had moved the High Court in July arguing Mukul Roy’s Election as Chairman of the Public Accounts Committee (PAC) and pleaded for nomination of an Opposition Member to the post as per Tradition.
