PM Security Breach: SC to hear PIL against Punjab Govt tomorrow

The Supreme Court of India decided to hear the Public Interest Litigation (PIL) on January 7, 2022 pertaining to the breach in security of Prime Minister Narendra Modi, on part of the Punjab Government, that occurred on January 5, 2022 during Prime Minister’s visit to Ferozepur, Punjab.

The Petition filed by an organization called Lawyer’s Voice, seeks Judicial cognizance for the incident that took place on a flyover where the Prime Minister’s convoy was stopped from moving forward by a group of protesters, while also stating the Security breach as a ‘Serious and deliberate lapse’.

A Three-Judge Bench of the Supreme Court headed by Chief Justice of India N V Ramana and consisting of Justices Surya Kant and Hima Kohli ordered the Petitioner to submit a copy of the PIL to the Advocate(s) representing Punjab Government.

A Senior Advocate named Maninder Singh argued, “He (Modi) was visiting Firozpur. It is extremely relevant to ensure it does not happen again and responsibility for this lapse should be fixed.”

The Advocate pointed out, “A professional and effective investigation is needed into the bandobast (security arrangement) … It would be appropriate under your monitoring for district judge of Bathinda to take into custody the entire records of the movements and deployment of Punjab Police in connection with the visit and produce before this court.”

The Petitioner also stated that the Director General of Punjab Police and Punjab Government’s Chief Secretary are Respondents to the case.

The Petition read, “Issue a writ of mandamus or any other writ, order or direction fixing responsibility of respondent No. 2 (chief secretary) and respondent No.3 (DGP) and place them under suspension, and further direct respondent No. 4 (Centre) to initiate departmental action against the same.”
