Plea filed for the transfer of petition on Uniform Civil Code; seeks directions from SC

A petition had been filed by the BJP Leader Ashwani Upadhyay, in the Supreme Court that sought for directions to transfer it from the Delhi High Court to the top Court to resolve upon a petition on framing the Civil Code to promote Fraternity, Unity and National integration.

He urged the apex Court to transfer the plea and decide on it so as to secure gender justice and equality of women in light of Articles 14, 15, 21 and 44 of the Indian Constitution and International Conventions.

The Plea seeks directions from the Supreme Court to either constitute a Judicial Commission or an expert Committee that can draft the Uniform Civil Code or Indian Civil Code within the duration of three months.

This will be done while considering the best practices of all Personal and Civil Laws pertaining to the developed countries and International Convention and publish it on their website for minimum of sixty days for considerable debates and feedbacks.

Furthermore, it also sought for directions to the Law Commission of India to draft Uniform Civil Code or, Indian Civil Code in the spirit of Articles 14, 15, 21 and 44 of the Indian Constitution.
