P&H HC Stays Arrest of Deepak Chaurasia in POCSO Matter, Directs Him to Appear Before Gurgaon Trial Court

The Punjab and Haryana High Court stayed the arrest of Deepak Chaurasia in case of POCSO and directed him to appear before the Gurgaon trial court before November 17.

A case registered against Deepak Chaurasia in 2015the Section 67B of the Information Technology Act, Sections 469, 471, 180, 120B of the Indian Penal Code and Section 23 of the POCSO Act, 2012.

Early this October, the trial court quashed Chaurasia’s bail and issued arrest warrant against him, as he failed to comply with court’s summon order. Although he moved application of exemption on ground of a health emergency, the court remarked said he was “intentionally avoiding his presence” before the judge.

Justice Vivek Puri said Chaurasia shall move an application for bail and recall of warrant of arrest, before the Gurgaon court.

The arrest of the petitioner shall remain stayed and the coercive steps ordered in the impugned order against the petitioner shall remain in abeyance till the disposal of the bail application and for a period of 07 days thereafter in the event the application is dismissed,”

According to a new portal report, Chaurasia is among the eight people who were charge-sheeted for telecasting “edited”, “obscene” videos of a ten-year-old and her family and linking the video to the sexual assault case against self-styled godman Asaram Bapu..
