Patna HC seeks state’s response on functioning of unregistered hospitals

The Patna High Court sought response from Bihar State Government regarding the functioning of unregistered hospitals.

A bench of Chief Justice Sanjay Karol and Justice S Kumar was hearing two petitions which sought implementation of Clinical Establishment (Registration and Regulation) Act, 2010.

In the previous hearing, the first amicus curiae, advocate Rani highlighted in her note that all clinical establishments are mandatorily required to be registered as per Section 12 of the Clinical Establishment Act.

She further notified the court, that certain unregistered hospitals are functioning as Covid hospitals.

Similarly, various hospitals empanelled under Ayushman Bharat Scheme are also not registered under the Act.

She further highlighted that the District Authority is also not inspecting unregistered clinics and hospitals.

She also mentioned that the State Medical Council for the State of Bihar remains dismantled while no records were maintained as per the required digital format.

She concluded her note, “The inaction of the respondents is only haring the health of the public at large but also boosting the quackery practice by unqualified doctors in the State of Bihar.”

The second amicus curiae, advocate Ram Krishna also highlighted the non-implementation of registration of hospitals in the state.

In addition, he emphasized that many labs and pathology centres are also running unregistered.

The Court directed the State to respond regarding these concerns in the next hearing.
