Orissa High Court expresses Inability to grant Relief to Ex-Serviceman

Orissa High Court conveyed its helplessness in providing any relief to an Ex-Serviceman, Dandapani Dash seeking his right of entitlement to a piece of land.

In the plea filed before the Orissa High Court, Dandapani Dash had claimed his ownership, on a plot which was allotted to him at Ripiti Palli under Ghumusar tehsil in Ganjam district, under Jawans-Grant of concession of the land scheme, 36 years ago.

After the Record of Rights (RoR) was issued, in the name of Dandapani Dash, the Consolidation Record published in 1991 showed the name of two other persons as the allottee of the plot.

The land records presented in the matter indicated two subsequent purchases of the same land by two different persons through a registered sale deed.

After various pleas before concerned authorities, including the Minister of Revenue and Disaster Management, Dandapani Dash approached the High Court in 2019.

The petition filed by Dandapani Dash sought the Court to provide orders to Revenue Department for transferring the Consolidation Record in his name.

The bench comprising of Chief Justice S Muralidhar and Justice SK Panigrahi said, “It appears to the Court that too many disputed questions of fact make it difficult for the Court to entertain this petition and issue the directions as prayed for. Two registered sale deeds are coming in the way of the present petitioner asserting rights, title and interest on the property in question. Unless the petitioner can overcome these difficulties, it is not possible to issue any directions.”
