Orissa HC Raises Alarm Over ‘Sarpanch-patism’ as husband Working As ‘Proxy’ For Sarpanch Wife Defeats Purpose of Women Reservation

The Orissa High Court, in a recent verdict by the Single Bench of Dr. Justice Sanjeeb Kumar Panigrahi, expressed grave concerns over the practice of husbands or male family members acting as ‘proxy sarpanch’ in place of elected female sarpanches. Termed as ‘Sarpanch-patism,’

The court highlighted that such a system undermines the constitutional intent of the 73rd Amendment Act, 1992, aimed at empowering women at the grassroots level.

The court was addressing a writ petition filed by a ‘Gaon Saathi’ who faced restrictions in performing duties due to the husband of a female sarpanch in Kalahandi district.

The petitioner claimed that he was pressured by the sarpanch’s husband to misrepresent the presence of job card holders under the MGNREGA scheme, leading to his removal from the position.

The court observed that this form of ‘Sarpanch-patism’ deprives women of their agency, autonomy, and voice in public affairs, violating their constitutional rights and dignity.

The judgment emphasized the need to combat patriarchal attitudes disguised as proxy sarpanches and practices that hinder women’s participation in public life.

The court directed the Secretary, Panchayati Raj Department, to provide details on actions taken against proxy sarpanches and steps taken for capacity building training for women sarpanches. It stressed that addressing the issue is crucial for preserving the democratic foundation at the grassroots level.
