Nikhil Dwivedi drags Kamaal R Khan to court, gets injunction against his defamatory posts

The Bombay High Court has passed an order restraining bollywood entertainer Kamaal R Khan from commenting or uploading any “defamatory” videos on YouTube on Producer-Actor Nikhil Dwivedi.

The court has likewise allowed Kamaal R Khan a 30 day-time to file a response in regards to Dwivedi’s defamation suit.

The Actor-Producer is being represented by advocate Mr Rohan Kelkar, Mr Kartikeya Desai and Mr Asadali Mazgoanwala.

Senior Advocate Virendra Tulzapurkar, who is also appearing on behalf of Dwivedi, submitted a series of defamatory reviews, posts and comments made by Khan before the Hon’ble Court.

Our client Mr Nikhil Dwivedi, a producer and an actor, has recorded a suit against Mr Kamaal R Khan for the libelous tweets and YouTube posts, which were uploaded by Mr Kamaal R Khan wherein he had offered disparaging and defamatory expressions and furthermore ridiculous charges against Mr Dwivedi”, stated the  senior advocate.

Tulzapurkar also brought court’s attention to a particular twitter post in which KRK had tagged the Enforcement Directorate (ED) and the Income Tax (IT) Department.

During the previous hearing on March 4, 2021, Tulzapurkar had informed the court that Kamaal R Khan’s tweets are an intentional attempt to damage his client’s public image and “lower him in the eyes of right thinking individuals of the society”.

He further said that Dwivedi had overlooked Khan’s underlying remarks and posts in September 2020, however the actor persevered and uploaded another defamatory “review” in January this year.

Tulzapurkar also added that though KRK was served the Court’s summon notice, however, he did not appear before the Hon’ble Court.

Justice A.K. Menon, taking in consideration the second “review” stated that the post and comments made by Khan indeed makes a prima-facie suit against him.

“In the present condition, I have no hesitance in allowing ad-interim relief against him,” the judge noted.

According to the court’s order, the controversial actor is prohibited or restrained from distributing, appropriating or spreading anything directly or by implication against Dwivedi.

Reacting to the news reports, Kamaal Rashid Khan again posted on the social media platform, Twitter, stating that he has no knowledge of any such suit against him,

He further said that he has not received any notification from the court.

The Actor at that point added he will post one more video about Dwivedi “in light of the fact that he needs better treatment”.

A week ago, KRK had tagged the account of Twitter Support alleging that Dwivedi was sending them fake e-mails.

“There is no suit against me in any court! Thanks”, Khan tweeted.

As per the reports of a leading entertainment portal Koimoi, Dwivedi, who is famous for producing Bollywood movies like Dabangg 3 and Veere Di Wedding, is the third actor to have filed a case against Kamaal R Khan for such defamatory posts.
