NHRC recommends CBI Investigation in WB post Poll Violence, signals Police Complicity and State Apathy

National Human Rights Commission (NHRC) has constituted a committee for examining the complaints filed by persons displaced in post-poll violence in West Bengal as per the directions of a five-judge bench of the Calcutta High Court.

Ravi Jain constituted by the Chairperson of NHRC Justice Arun Mishra, as the head, took the lead in the matter.

Regarding the situation, the NHRC recommended the Central Bureau of Investigation (CBI) probe in the matter, stating that, “manifestation of the law of ruler instead of rule of law.”

The committee examined all the post-violence cases received to NHRC and West Bengal Legal Services Authority and prepared a report to be submitted in the Calcutta High Court.

Detailing all the particulars and modalities including nature of the inquiry, number and nature of complaints, findings of the spot visits and camp-sittings were followed in the preparation of a 50-page report, the NHRC submitted the report before the Calcutta High Court on July 13, determining all the issues examined so far. 

“Analysis of statements recorded of the victims/complainants, supporting documents, data and other related information collected from the spot enquiries, including camp sittings, registered cases, etc., revealed that a large number of criminals, who enjoy state patronage and support, were responsible for abetting, planning, organising and even committing offences in a systematic and widespread manner,” the report states.

The report indicated that “The post-poll violence in West Bengal is the retributive violence of supporters of the ruling party against the supporters of the opposition party.”
