MLA Pradeep Choudhary conviction stayed by Himachal Pradesh HC

On Tuesday speaker of the Legislative Assembly Gian Chand Gupta said that he will only be able to comment on the effect of the stay on Congress leader Pradeep Chaudhary’s conviction by the Himachal Pradesh High Court after receiving a copy of the order.

In January of this year, a Baddi court found Chaudhary guilty of rioting and sentenced him to three years in jail.

As a result, he was removed from the Haryana Assembly seat of Kalka under the Representation of People Act.

According to Section 8(3) of the Representation of People Act, a person convicted of any crime and sentenced to a term of imprisonment of not less than two years is barred from holding public office from the date of conviction and for a period of six years after his release.

The conviction order against him was stayed by the High Court on Monday.

Gupta said “I have also come to know about the stay on the conviction through newspapers,” when asked if Chaudhary’s membership will be restored.”
