Manipur HC Stays construction on land reserved for park in National Games Village

The Manipur High Court has Ordered for status quo and discontinue all the construction work on the plot kept aside for National Games Village at Meitei Lango.

The Division Bench of Chief Justice Sanjay Kumar and Justice MV Muralidaran passed this Order while hearing of a Public Interest Litigation (PIL) asserting that no appropriate legal procedure was followed for the change of land used in as much as the area set aside for the Public Park that has now sought for constructing quarters.

The Court observed from the record and project plan submitted by the Petitioners that the land was shown as ‘Park A’ in the Layout plan of the National Games Village which is now being used for different purpose.

However, the Court also noted that there is no evidence to prove that the Authorities have not followed the proper procedure for the change of land in use.

The Court stated that Section 33 of the Manipur & Country Planning Act, 1975, states the proper procedure with this regard but there is no evidence of such procedure been followed in this Case.

The prescribed procedure asks for the public participation prior to the modifications in the plan but the High Court found that according to the Cabinet decision, the steps required for the construction is been taken speedily.

The Court Ordered as, “The respondents shall accordingly maintain status quo in all respects obtaining as of today in relation to the subject land, shown Park A in the layout plan for the National Games Village at Meitei Langol and till the next hearing discontinue all the construction activity.”

The Court has reserved this matter for January 18, 2022.
