Lakhimpur Kheri Violence: SC Issues Notice to UP Govt on Ashish Mishra’s Bail Plea

The Supreme Court issued a notice to the Uttar Pradesh Government on a plea filed by Ashish Mishra, the son of Union Minister Ajay Mishra Teni, challenging the Allahabad High Court’s decision which denied him bail in connection with the Lakhimpur Kheri Violence Case.

A Bench comprising Justices Indira Banerjee and MM Sundresh was considering the petition filed by Mishra challenging the July 26 order of the Allahabad High Court which dismissed his regular bail application.

The State has been asked to file its response by September 26.

The Allahabad High Court had granted bail to Mishra on February 10th, but it was set aside by the Supreme Court in April 2022 after they came to know that the High Court took irrelevant considerations into account and ignored the rather important ones.

Senior Advocate Mukul Rohatgi, appearing for Mishra, said that the allegation was that 4 people were moved down with the vehicle, but that the vehicle was driven by the driver and not him.

There are a total of 2 FIRs filed against Mishra, one pertaining that Mishra had ran out of the car and fired shots from a sugarcane field. However, the witness did confirm to being an eyewitness.

The Supreme Court in November 2021 appointed Justice Rakesh Kumar Jain, former judge of the Punjab and Haryana High Court, to monitor the investigation of the Lakhimpur Kheri Violence.

The crime was committed on October 3, when there were protests against the visit of Deputy Chief Minister Keshav Prasad Maurya to Lakhimpur Kheri district. The four framers who were a part of the protest were knocked down by an SUV that was a part of the convoy of Ashish Mishra.

A PIL filed by two lawyers seeking information on the biased investigation of the Lakhimpur Violence Case was heard by the former Chief Justice of India NV Ramana.

Further, the police arrested Mishra on the crucial remarks of the Supreme Court.
