KHCAA Expresses Concern Over Judge’s Conduct, Calls for Mandatory Video Recording of Court Proceedings

The Kerala High Court Advocates’ Association (KHCAA) has voiced its displeasure with the behavior of Justice A Badharudeen, a sitting judge, in a letter addressed to Kerala High Court Chief Justice AJ Desai.

The letter, characterized by strong language, cites instances of alleged humiliation and insensitivity towards lawyers in court, urging the Chief Justice to take action.

The association, in its letter, reveals receiving complaints from several lawyers regarding Justice Badharudeen’s behavior, with the most recent incident involving the refusal of adjournment to advocate Jayakumar Namboodiri TV despite a severe back injury.

The letter expresses the bar’s discontent with the judge’s conduct and recommends mandatory video recording of court proceedings in all courtrooms to curb inappropriate behavior from both the bar and the bench.

Until the implementation of such recording measures, KHCAA advises its members to independently record court hearings.

The association’s letter emphasizes the need for sensitivity and decorum in dealing with advocates, calling for a more respectful and cooperative atmosphere.

The letter also recounts an incident where Justice Badharudeen published supplementary lists at 10:30 am, listing several cases for which advocates were not informed.

Subsequently, the judge dismissed those cases for lack of representation, causing concern among legal practitioners. The letter highlights the importance of fair communication and proper procedures in the courtroom.

Additionally, the association brings attention to recent protests by lawyers in a Kottayam Magistrate Court, resulting in contempt of court action against 29 lawyers. KHCAA asserts that the conduct of the magistrate leading up to the incident, as well as the behavior of other judges, has been overlooked.

KHCAA concludes the letter by affirming its resolution to refrain from strikes, boycotts, or protests. The association expresses hope that Chief Justice AJ Desai will counsel Justice Badharudeen to handle interactions with advocates more sensitively, assuring cooperation in addressing the matter.
