A man in Kerala has been convicted and sentenced for the act of permitting his underage brother to operate his motorcycle. [State v Roshan Shiju].
Additional Chief Judicial Magistrate Naina KV presided over the case and considered the man’s negligence in failing to display the registration mark on both the front and back of the vehicle.
Consequently, the court decided to cancel the motorcycle’s registration for a duration of 12 months. Additionally, the man’s driving license has been revoked for a period of three months. These penalties serve as a stern reminder of the importance of adhering to traffic laws and ensuring the safety of all road users.
The legal proceedings stemmed from a consumer complaint filed by the Assistant Motor Vehicles Inspector at the Regional Transport Office (enforcement) in Kakkanad. The complaint alleged that the accused individual knowingly allowed his minor brother to ride the motorcycle from Aluva to Patteripuram on April 24, 6 PM.
Furthermore, the complaint revealed that the motorcycle lacked essential safety features, such as a sari guard, direction indicator lamp, and rearview mirrors. These violations were considered as offenses punishable under the Central Motor Vehicle Rules and the Motor Vehicles Act, 1988.
The man, realizing the gravity of the charges against him, pleaded guilty to the alleged offenses during the trial. Consequently, the Magistrate handed down the sentence, imposing simple imprisonment until the court adjourned for the day. Alongside the imprisonment, the man was directed to pay fines amounting to ₹34,000, reflecting the cumulative penalties for each offense he was convicted of.
