Karnataka High Court: If the college has prescribed a uniform, it must be worn untilthe matter is resolved

The Karnataka High Courts special Bench clarified today that if a college has stipulated a uniform, it must be followed regardless of whether it is a degree college, Government college, or whatever until the matter is resolved.

The Court stated this to clarify the interim arrangement after a counsel stated before the Court that degree students have filed a petition seeking clarification as to whether it will apply to them.


According to the Counsel, some colleges are using the order to mandate uniforms overnight, putting students in jeopardy. He went on to say that, with the practical exams approaching, there is an urgent need for clarification.


Advocate General Prabhuling Navadgi said, “He has filed a writ petition in respect of Bhandarkar college, the institution has said that they have passed a resolution saying that they have a uniform.”


He also stated that if someone violates a court order, the act of violation should be challenged
and a writ petition seeking clarification cannot be filed. Another counsel claimed that teachers are being forced to remove their headscarves, but the court stated clearly that the order only pertains to students, not teachers.

According to media reports, the petitioners are studying business administration at the college
and claim to have been wearing a hijab over their college uniform. It goes on to say that there
is a specific rule that allows Muslim students to wear Hijab.

According to the petition, they were abruptly barred from wearing Hijab on February 3rd due to a government order. The petition also claims that neither the UGC nor the Karnataka State University Act require college students to wear uniforms.

According to reports, the plea also claims that they are being persecuted for political reasons due to their status as Muslim students.As per reports, the petitioners requested an interim injunction to allow them to wear Hijab without bias or discrimination.
