Karnataka HC: Police Bound to Conduct Investigation After Magistrate Accepts Complaint U/s 200 CrPC

The Karnataka High Court has recently ruled that once the Court accepts that a Complaint filed under Section 200 Criminal Procedure Code and asks the police to investigate it then the police cannot decline to investigate it.

The Single Judge Bench of Justice M Nagaprasanna allied the Petition filed by Ashwani and set aside the Order of Endorsement issued by the Police.

The Petitioner approached the Court seeking to get a Complaint under Section 200 CrPC registered before the Additional Chief Metropolitan Magistrate, Bangalore seeking to Investigate under Section 156(3) CrPC and the Court directed the case be registered.

As per the Petitioner’s Counsel the Police’s inaction on the Report and not investigating the Case is illegal. It was further submitted that once the Magistrate Orders, an Investigation then the Police have to go ahead with the same.
