Karnataka HC dismisses RGUHS writ pleas on fake marks cards

The Karnataka High Court dismissed a batch of writ appeals, filed by Rajiv Gandhi University of Health Sciences (RGUHS), in connection with the disaffiliation of nursing colleges run by Bethel and Hosmat Group in Bengaluru city on charges of producing fake marks cards.

“The university, senate, academic council, syndicate, and the state government have not followed the procedure under section 48 of the Rajiv Gandhi University of Health Sciences Act,1994 and had grossly violated the principles of natural justice,” the bench said in the order.

The RGUHS stated that during a surprise inspection on March 7,2018 it was found that the colleges were indulged in making fake marks cards. The government had ordered disaffiliation of the colleges on October 2019.

Vice-chancellor M K Ramesh denied such allegations and said, “These are fake, and we do outsource printing. There is no evidence pointing to insider role. We are confident someone from outside is doing this to tarnish our image or gain employment somewhere. They have used my signature on a marks card when I wasn’t even the registrar”.

A single bench allowed the petition filed by the colleges and affected students challenging the state government order. The RGUHS moved writ appeals challenging the same.

The division bench said, “Even the acceptance by the government does not indicate any application of mind. There is a violation of section 48(6) of the Act which requires the government, if necessary, to hold such inquiry and thereafter make its recommendation”.
