Karnataka HC Denies Bail to Police Officer Accused in Dowry Death Case: Prima Facie Evidence Stressed

In a Criminal Appeal challenging the Trial Court’s rejection of the husband’s bail plea, the Court ruled against granting bail to the Sub-Inspector husband, emphasizing his potential interference with prosecution evidence.

Justice Mohammad Nawaz highlighted, “Based on the evidence collected by the prosecution, there exists a prima facie case against the appellant for the offenses charged. Granting bail might lead to tampering with the prosecution’s evidence.”

The case emerged from an FIR filed against a Police Sub-Inspector at Begur Police Station, accused of mistreating and attempting to kill Shilpa. V., his wife. Despite marital opposition, they wedded, yet the abuse continued. Charges under various sections of the IPC, DP Act, and SC/ST Act were filed against the appellant.

The Appeal contested the Trial Court’s denial of bail under Section 439 of CrPC. The Court highlighted the suspicious circumstances surrounding the death, with the charge sheet citing physical and mental torture by the Appellant.

The Court stressed the significance of the prima facie evidence revealed in the prosecution’s material and upheld the denial of bail, considering the gravity of the offense and the potential for tampering with evidence.

As a result, the Appeal was dismissed by the Court.
