Karnataka Govt Announces Y Category Security for Hijab Judges Following Police FIR For Threatening Message

The Karnataka Government has decided to provide ‘Y’ Category Security cover to three Karnataka High Court judges, including Chief Justice Ritu Raj Awasthi, who were part of the Bench that upheld the Ban on wearing hijab inside classrooms in colleges with a prescribed Dress Code.

While addressing to the media on Sunday, Chief Minister Basvaraj Bommai announced the decision.

He stated that this was in response to the Police filing a First Information Report after a video went viral on Social Media containing life-threatening remarks directed at the Judges who were part of the Bench that rendered the Judgement.

On March 19, a FIR was filed with the Vidhana Soudha Police station in Bengaluru as Crime No. 18/2022, based on a complaint filed by Advocate Sudha Katwa.

The Police reported the incident in accordance with sections 506 (1), 505 (1) (C), 505 (1) (b), and 153A, 109, 504, 505 (2) of the Indian Penal Code.

According to the Lawsuit, the speaker in the video addresses the Chief Justice in a distinct manner and openly defies the filing of any action against him.

He also uses obscene words while addressing Judicial Decisions.

On March 15, a Panel comprised of Chief Justice Ritu Raj Awasthi, Justice Krishna S Dixit, and Justice JM Khazi ruled that wearing a headscarf is not an essential Religious Practice in Islamic religion and so is not protected under Article 25 of the Constitution.

A Full Bench of the High Court also ruled that the State’s prescription of school uniforms is a legitimate limitation of student’s Rights under Article 25, and so the Government Order issued by the Karnataka government on February 5 is not a violation of their rights.
