Interim orders passed by Delhi HC and subordinate courts to extend till 16 July 2021

On Tuesday the Delhi High Court ordered that all interim orders issued by it and its subordinate courts that were in effect on April 19, 2021 will be extended until July 16, 2021, or until further orders are issued.

The court said, “taking Suo moto cognizance of the aforesaid extraordinary circumstances, it is hereby ordered that in all matters pending before this court and courts subordinate to this court, wherein such interim orders issued were in effect as of April 19, 2021 and have expired or will expire thereafter, the same be automatically extended until July 16, 2021.”

On Monday, a Division Bench of the High Court took notice of the issue Suo motu and referred the case to the Chief Justice for the constituting of an appropriate Bench to issue orders.

The Division Bench had made a statement that, “the routine matters will be adjourned en-bloc to the dates to be informed, due to the GNCTD’s curfew and the Courts’ extremely limited functioning. As a result, advocates and litigants may be unable to appear in the above matters, including those in which this Court or the Courts Subordinate to this Court has issued a stay, bail, or parole on or before 19.03.2021. As a result, temporary orders in favour of the parties will begin to expire on and after April 19, 2021.”

Following that, on Tuesday, the matter was heard by the full bench of Justice Vipin Sanghi, Justice Rekha Palli, and Justice Talwant Singh, who decided to extend all interim orders.

The Court said, “needless to say, if the aforementioned extension of temporary order causes any serious hardship to a party to such proceeding, they will be free to request reasonable relief, as may be advised.”
