Chief Justice of India DY Chandrachud emphasized on Sunday that an independent judiciary goes beyond the separation of powers from the executive and legislature; it also involves the individual judges’ independence in performing their duties.
Speaking while heading a ceremonial bench at the Supreme Court to commemorate its 75 years, CJI Chandrachud acknowledged the constitutional safeguards but highlighted that true judicial independence extends to judges’ autonomy.
CJI Chandrachud stated, “An independent judiciary does not merely mean the insulation of the institution from the executive and the legislature branches but also the independence of individual judges in the performance of their roles as judges.”
During the ceremonial bench, which included judges, lawyers, and former apex court judges, the Chief Justice discussed the constitutional safeguards such as a fixed retirement age and the prohibition of altering judges’ salaries after appointment.
He noted, “The art of judging must be free of social and political pressure, and from the inherent biases which human beings hold.”
CJI Chandrachud mentioned ongoing efforts within the institution to educate judges across courts on overcoming subconscious biases related to gender, disability, race, caste, and sexuality.
The Chief Justice addressed the historical significance of the Supreme Court’s 75 years, acknowledging the enduring relevance of principles established during its inaugural sitting on January 28, 1950. He praised the court’s response to challenges, emphasizing its commitment to democratic ideals governed by the rule of law.
CJI Chandrachud underscored that the principles highlighted during the court’s establishment remain crucial today. He reflected on the court’s evolution in addressing injustice and meeting the expectations of those affected by power. He also mentioned the importance of securing citizens’ respect for the court’s legitimacy.
The ceremonial bench marked the inauguration of the Diamond Jubilee Year of the Supreme Court’s establishment, with Prime Minister Narendra Modi as the chief guest.
