Himachal Pradesh HC: Death Certificate is not Third Party Information

The Himachal Pradesh High Court ruled on Friday that a party’s Death Certificate cannot be classified as ‘Third Party Information’ under Section 11 of the Right to Information Act as it only relates to the deceased.

The Bench of Justice Tarlok Singh Chauhan while hearing a plea regarding application seeking a copy of the death certificate, names and addresses of legal representatives of a deceased being denied as per Section 8(1)J and Section 11 of Right to Information Act, 2005 directed the Panchayat Secretary of Shingla to provide him the same.

The Bench asked for an explanation during the hearing from the Secretary, while the previous hearing was in process.

The Court pursuant to its Order was informed by the concerned Public Information Officer(PIO) regarding the same.

The Court later passed an order with respect to the response filed by PIO observing, “To say the least, the interpretation given by the Additional Director (Panchayati Raj) is based on total misunderstanding, misconception and misinterpretation of the provisions of the Right to Information”.
