Gold Smuggling Case: Swapna Suresh moves Kerala High Court for Bail

The prime accused in the case of Gold Smuggling, Swapna Suresh has moved to Kerala High Court for grant of bail.

The case of Gold Smuggling was registered by the National Investigation Agency (NIA) against her.

The division bench comprising Justice K Vinod Chandran and Justice Ziyad Rahman A. A will be taking up the matter today.

Challenging the verdict of the Special NIA Court, Swapna Suresh through her advocate Sooraj T Elenjickal has moved to the Kerala High Court after filing the bail application.

In pursuant to the investigation conducted by Enforcement Directorate (ED), NIA and Customs Department, Swapna was arrested and was held in custody for illegal smuggling of gold in large quantities via diplomatic channels from foreign countries.

Swapna was accused of a criminal conspiracy with the intention to threaten the National Economic Security. 

Suresh, in her bail plea, contended that the charges against her under Section 43D(5) of Unlawful Activities (Prevention) Act (UAPA) would not stand as the prosecution has failed to prima facie make out any offences that would attract said section. 

Swapna claimed that there is no sufficient material evidence to allege her for criminal contention. She denied all the allegations against her.

In bail plea, Swapna prayed before the Kerala High Court for grant of bail setting aside the order passed by the Special NIA Court.
