Directives issued by Delhi HC against misuse of power by Contractors at Central Government Hospitals

On the 27th of October 2021, Justice Pratibha M. Singh of the Delhi High Court ruled in favor of the Petitioner in the case of All India General Kamgar Union v. Union of India and Ors over a dispute about the termination of workers by a new contractor appointed at the Lady Hardinge Medical College and Associated Hospitals in New Delhi.

The conflict occurred due to the illegal termination of contractual workers at the Lady Hardinge Hospital. The workers stated that they were being pressured to pay money for continuing their employment by the new contractor.

The Delhi High Court provided a set of directives for the proper functioning of all the Central Hospitals and Lady Hardinge Hospital. The directives ensure that any contractor who is in charge of a temporary workforce does not indulge in any kind of malpractice.

The Court stated in the Order that the responsibility lies upon the Medical Superintendent of the hospital to ensure the safety of the contractual workforce of the hospital. 

“For the selection of the contractual firm through Government e-Market (GeM), two separate and independent committees, bid finalisation committee and bid evaluation committee, comprising non-administrative faculty members will be constituted,” said Justice Pratibha M. Singh in a 15-page order.

The Court stated that the administration has to conduct interactive sessions with the workforce quarterly to make sure that there is a sense of transparency regarding the management of their work and payment of their salaries.

The Judge said that the administration has to come up with a proper system, relating to the confirmation of the employment of the contractual workers, through identity cards and legal documents.

The Order also stated that the committee should provide the temporary workers with a complaint box where they can submit their complaints regarding their employment anonymously.
