Delhi HC restrains Netflix to telecast documentary based on Gurugram School Murder Case

The Delhi High Court has restrained Netflix and other broadcasters for telecasting documentary titled ‘A Big Little Murder’ based on a Gurugram School Murder Case.

The story of documentary is based on the tragic death of a 7-year-old boy who was found dead in the washroom of a school based in Gurugram, where he studied.

Dealing with the plea, the bench headed by Justice Jayant Nath clarified that, “The defendants may stream the documentary after deleting all references to the school in question and also deletion of portions where school’s building.”

The documentary had been released on Netflix on August 6 and featured the death of the child in 2017.

Against the streaming of the documentary which was being promoted on the website of Channel News Asia (CNA) and Netflix., the school’s trust namely Xavier’s Education Trust approached the Delhi High Court by way of an application under Order 39 Rules 1 and 2, Code of Civil Procedure (CPC).

The petitioners sought for an ex parte injunction to restrain the defendants from marketing, broadcasting, streaming, telecasting and making available in any form or in any medium the documentary or its trailers or abridged versions and also to take down the same from the websites and social media platforms.

The Court observed that the impugned act is contrary to the orders passed by the Additional Sessions Judge, Gurugram and the co-ordinate bench of this court. The defendants have violated a Court order on the protection of privacy and the reputation of the parties involved in the case.

The Court passed the ex parte order after opining that the school’s trust made out a prima facie case in its favour,

The matter will be further heard on October 10.
