Delhi HC: Notice to Jail Superintendent for not taking Prisoner to Hospital

Delhi High Court has issued a notice to the Superintendent at Tihar Jail and has directed him to present his reasons on why contempt proceedings should not be initiated against him for failing to get an inmate admitted to the hospital for required surgery, despite the Court’s directions and resumption of normal surgeries after a decline in the second wave of Covid-19.

The petitioner, who was a prisoner in Tihar jail, reached the High Court for getting bail on medical grounds. As submitted in medical reports, the prisoner was advised two to three days’ admission for incision and removal of painful lymphoma.

On this, the Court granted bail to the prisoner and directed to give him adequate security to be in custody.

The single bench of Justice Mukta Gupta further directed the Jail Superintendent to take appropriate measures for the treatment of the prisoner, and also ordered him to submit his medical reports to the Court.

The Jail Superintendent failed on performing the orders of the Court.

The Court stated, “It is unfortunate that despite surgery of the petitioner required to be performed and now in various hospitals at least from July 2021, the Covid cases being under control, normal surgeries are being performed, the Superintendent has made no efforts to take the petitioner to Patel Hospital for surgery.”

The Jail superintendent contended that the petitioner was taken to Patel Hospital, but doctors advised him to come back after few days because his high blood pressure became an issue.

Jail Superintendent further said that he was later not notified by the Hospital, so he didn’t take the prisoner to the hospital. The matter will be further heard on 18th August.
