Delhi HC adjourns Raj Kumar Plea seeking inclusion in Tokyo Paralympic Games Law Insider

The Delhi High Court on Monday, adjourned its hearing on a plea filed by Arjuna Awardee and former Para-Badminton World Champion Raj Kumar, seeking direction to include his name, along with Parul Dalsukhbhai Parmar, at the upcoming Tokyo Paralympic Games 2020.

A Single-Judge Bench of Justice Rekha Palli delayed the hearing, after the Senior Advocate Navin S Kohli, standing on behalf of the Badminton Association of India, submitted that he wanted to rely on a compilation of documents that could not be produced owing to a lack of time.

According to the Race to Tokyo Paralympic Ranking List, Raj Kumar and his partner Parul Dalsukhbhai Parmar were ranked No. 6 with a total of 2360 points, while Parmod Bhagat and Palak Kohli were ranked No. 31 with a total of 50 points.

Mr. Kolhi submitted that the role of the Badminton Association of India in the selection of players is limited to receiving invitations and confirming the same.

Mr. Kolhi added that the Bipartite system is a discretionary mechanism that comes into play if someone is not available on merit and that the Badminton Association of India has no role in this system.

Advocate Sunny Singhla, appearing for the petitioner, informed the Court that the petitioner’s entry was sent by the Badminton Association of India on June 16, 2021.

Mr. Singhla stated that on June 24, 2021, the Association received an email stating that it had to choose between two pairs: Pramod Bhagat and Palak Kohli or Tarun and Jyoti and that in response to this email, the Association chose the entry of Pramod Bhagat and Palak Kohli, while the petitioner’s entry was still under consideration.
