Delhi Court questions Police for calling a man to Police Station w/o Formal Complaint

A Delhi Court expressed its disapproval with a police officer for summoning a man to the police station without having filed a formal complaint against him, claiming that the official had deceived the Court by providing false information.

Additional District and Sessions Judge Atul Kumar Garg said, “I fail to understand that how the police station has been converted into public call booth and the duty officer posted therein had acted at the behest of the complainant to call any person without having any complaint against the person,”

The SHO of the police station, as well as the Head Constable and Sub Inspector, were ordered to appear before the Court, along with the complainant.

Till then the police is restrained to act on the complaint lodged by the complainant,” the Judge added.

The Court was hearing an application submitted by a man through his Lawyer, Advocate Juhi Arora, alleging that his ex-girlfriend had subjected him to continual, threatening, mental harassment, tormenting, and blackmail.

The woman, he claimed, had written a suicide note and sent it to him via WhatsApp, accusing him of making false charges.

In light of this, the applicant said that he had gotten a call from the Mehrauli Police Station regarding a complaint lodged by the woman, which he claimed was fraudulent.

The investigating officer had earlier responded to the Court, indicating that no such complaint or FIR had been filed with the police station.

The Court stated at the outset,”At this, ASI Sunil who 15 present in the Court has stated and admitted that on 20.09.2021, HC Rajesh Kumar was working as duty officer and the complainant had appeared in the PS Menrauli and stated that the applicant has not been picking her call and asked the IO ajesh Kumar to call the applicant from police station and HC Rajesh Kumar had called the applicant by dialing the phone and he picked up.”
The Court was also informed that the complainant had filed a complaint on Friday, which had been forwarded to the Sub Inspector for investigation.

As a result, the Court ordered that a copy of the abovementioned ruling be provided to the DCP for information and action.
