Delhi Court denied bail to a man who reportedly spoke on the phone with his wife five minutes before she hanged herself.
The Court opined that if the man had been innocent, he could have avoided the incident, but he made no attempt to break open the door and stop his wife.
Amit Sharma, the accused, was denied bail by Special Judge, Sunil Chaudhary.
“I have found that the death of the wife of the applicant is not natural and the applicant was at home at the time of the incident and had made conversation with her for a long time telephonically. It was the applicant who could have avoided the incident if he was innocent but he did not make any effort to break open the door and to stop his wife from doing the act of suicide.” the Judge wrote in his bail order.
The Additional Public Prosecutor, Masood Ahmad, informed the Court that prior to the incident, the accused spoke with the deceased for approximately 377 seconds.
It is claimed that he informed the police that ‘One lady had killed herself’ but did not report that it was his wife.
Lawyer of the accused, Pradeep Teotia argued before the court that he had been falsely compromised and that the FIR itself reveals that all of the allegations were made with due deliberation, mala-fide intentions, and ulterior motive in order to create false evidence against him.
Except for bail charges from family members of the deceased, the Court was told there was no iota of evidence against the accused.
“It is submitted that the statement of witnesses recorded during the investigation is showing that one day prior to committing suicide by the victim she was leading her life happily and that the allegations of the demand of dowry are general in nature without disclosing any specific instance,” Pradeep Teotia contended before the Court.
