CJI Suggests SC Might Hear Shiv Sena Pleas After Eknath Shinde Group Seeks Urgent Listing

Hon’ble Chief Justice India UU Lalit gave indication that the SC might be listing the Shiv Sena Case tomorrow on urgent basis and will hear the resulting political development so far in the State of Maharashtra.

The plea was considered after senior counsel Neeraj Kishan Kaul, representing the Eknath Shinde group, sought an urgent hearing in the case related to the rift within the Shiv Sena party, giving reasoning that the case has already been delayed before the Election Commission of India regarding the determination of “real” Shiv Sena.

A three-judge court referred the cases to a Constitution Bench on August 24. Despite the three-judge bench’s declaration that the issue will be put before the Constitution Bench on August 25, Kaul argued that it was never listed. He also brought up the forthcoming municipal elections and emphasised the pressing need for a solution.

CJI Lalit said after a brief consultation with the other judged headed by Justice Ravindra Bhat “I can’t say off the cuff but certainly by tomorrow something will be there”,

In response to a request by Senior Advocate Kapil Sibal, speaking on behalf of the Uddhav camp, to prevent the Election Commission of India from making a decision regarding Eknath Shinde’s claim to be the official Shiv Sena party, the three-judge bench asked the ECI orally to refrain from taking any precipitous action during the hearing.
