CBI opposes Lalu’s bail plea in Dumka treasury case

Rashtriya Janata Dal chief Lalu Prasad’s bail plea was opposed by the Central Bureau of Investigation through the written form in Jharkhand High Court.

The plea was in a fodder scam case related to the Dumka treasury.

The former Chief Minister Lalu Prasad was incarcerated on March 24, 2018, for 14-years rigorous imprisonment by the CBI special judge Shivpal Singh in the Dumka treasury case.

He was convicted in three other fodder scam case and got bail in three. He would able to be free from jail if he acquires the last bail.

The CBI stated in its reply that Lalu Prasad has been convicted by CBI court for four different cases in fodder scam case and sentenced to 14 year’s rigorous imprisonment in the Dumka case.

The special CBI court has not stated anywhere in its order that the sentence in the Dumka case will continue along with the sentence given to other cases of fodder scam and the punishment under CrPC section 427.

The CBI, in its reply, also said that Prasad does not make any request to the CBI Special Court to carry out his sentences concurrently.

After the completion of sentences in three fodder scam cases, Lalu Prasad will be taken into judicial custody for the Dumka case.

The counsel appearing for Prasad requested the court to grant him bail in the case as he had served half his sentence and was suffering from diabetes, high blood pressure, heart disease, chronic kidney disease, fatty liver, and various other diseases.

The Jharkhand High Court postponed the bail plea hearing in the fodder scam case related to the Dumka treasury to November 27.
