Calcutta HC: A 3-member committee constituted to enable return of displaced persons in post-poll violence in West Bengal

The Calcutta High Court ordered a three-member committee to ensure the return of persons displaced by post-poll violence in West Bengal to their homes.

The five-judge bench ordered, “The people have a right to go back to their homes and live peacefully. It is the duty of the State to ensure that law and order are maintained” and that a report must be submitted by the committee in this regard.

The committee was to comprise nominees of the State Human Rights Commission, National Human Rights Commission and Member Secretary of the West Bengal State Legal Services Authority.

The Court further directed such people to communicate with the West Bengal Legal Services Authority (WBLSA) on their official email. The committee would then contact the police officer of the concerned locality to ensure that persons return to their homes.

The order was passed in response to a plea filed alleging that around 200 persons were displaced due to violence aftermath of the victory of All India Trinamool Congress in State Assembly elections, 2021 and that they have not been able to return to their house due to persistent threats to their lives.
