Bombay High Court to CBI: Widen probe into FIR against Anil Deshmukh

Stating that the head of the administration cannot plead innocence and was equally responsible, the Bombay High Court directed the Central Bureau of Investigation (CBI) to widen its probe into the FIR filed against Anil Deshmukh, ex-Home Minister of Maharashtra.

The Court stated that if the order dated on April 5 of the High Court is to be considered, then every person has to be looked upon, against the allegations of corruption, in the inquiry. 

The Court’s statement comes after Deshmukh filed an application seeking to quash the FIR filed against him on the grounds of corruption. He contended that the application is in furtherance to the misuse of the official power.

Deshmukh stated that the FIR has no locus standi wherein the allegation to collect Rs. 100 crore from bars and restaurants comes only after senior IPS officer Param Bir Singh was removed from the post of Mumbai Police Commissioner.

The Court observed that no person can plead innocence only on grounds that he was following the orders of the executive and hence the head of the administration is equally responsible.

Though cop Sachin Waze contented to be dangerous, the Court held that if the person was dangerous, then the committee who included him in the police force is equally responsible.

After Court asked to name all the culprits in the issue, Additional Solicitor General Aman Lekhi, appearing on the behalf of CBI contended that the investigation is at preliminary stage and no prima facie opinion can be framed.

Aman Lekhi assured that the CBI already knows the conspirators and will be disclosing names soon after confirmation and evidence.

Though the counsel on the behalf of Deshmukh argued that the CBI FIR lacks evidence and no offence is disclosed by them, the Court directed CBI to widen its probe.

The matter is listed for further hearing on 12 July.
