Bombay High Court: The Bachchans may sue the BMC again in the bungalow land case

The Bombay High Court on Wednesday permitted superstar Amitabh Bachchan and Jaya Bachchan, who had challenged the BMC’s notice about taking part of their Prateeksha bungalow land in Juhu for road extension work, to make an additional representation to the municipal corporation within two weeks.

The high court ordered that the BMC decide on the representation within six weeks, with a personal hearing by the municipal commissioner if desired, and that no coercive measures be taken for three weeks if the corporation issues an adverse order.

The Bachchans sought orders to vacate two notices authorised by the BMC for their land in April 2017. Their lawyers, Pravin Samdani, Neil Mandevia, and Nivit Shrivastava, sought a declaration that the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation, and Resettlement Act, 2013, a new land acquisition act, rendered the provisions of the BMC Act unenforceable and that the municipal corporation could not invoke its act instead of the new law, which provides for higher compensation for land.

According to them, the Bachchans have already made a representation to the BMC for February 17, 2022.

All of the contentions of both parties are expressly maintained. Open, said the high court, noting that it had not expressed any opinions on the merits of the case and had disposed of it.
