Bombay HC to pass injunction against private companies found giving COVID-19 drugs to citizens directly

On Tuesday, the Bombay High Court specified that if it found any private company procuring COVID-19 drugs and distributing them to the individuals directly then the court will pass an order of injunction against them.

The said order was passed after an incident took place in Maharashtra where a politician was found distributing Remdesivir illegally. The politician was caught distributing 10,000 vials of Remdesivir.

Thus, after this a plea was made alleging the improper management of COVID-19. The plea on COVID-19 management was earlier fixed for hearing on May 4. However, the Bench listed the matter today to get an update on the status of compliance of its previous order of April 23, 2021.

Taking this incident into consideration the Bench of Chief Justice Dipankar Datta and Justice GS Kulkarni asked the Solicitor General Anil Singh about the allocation of Remdesivir specifically in the state of Maharashtra. Justice Kulkarni also questioned the ASG as to how such an incident was feasible.

ASG informed the court that he would immediately look into the matter and take the necessary actions.

Justice Kulkarni further questioned that, “There was a news report that a political personality distributed 10,000 vials. How was that possible? When people are running from pillar to post when Delhi is itself in need… How could he airlift?”

The petitioner’s advocate Simil Purohit said that this was not the first incident in the state. The court further clarified that it would look into the matter immediately.
