Allahabad HC: Unjustified behaviour by Lawyers can erode public confidence in Judicial System

Allahabad High Court’s Lucknow bench has stated that unjustified and uncalled behaviour by Lawyers has the possibility to erode public confidence and trust in the Judicial System.

On December 24, Justice Devendra Kumar Upadhyay and Justice Narendra Kumar Johari made this statement while dismissing an old Contempt Plea against 12 Gonda district Lawyers. Only six of them are still currently alive, and they are all elderly people.

“What we have observed in recent times is the absolutely inappropriate and unwarranted conduct/behavior of Lawyers, which has the ability to diminish public faith and trust in the Judicial System,” the Court stated.

The Complaint was lodged in response to a letter written by the then-district Judge of Gonda to the then-registrar general of the High Court on August 17, 2001, requesting that Contempt proceedings be initiated against 12 lawyers.

According to the letter, these Lawyers were engaged in disorderly behaviour on the Court campus on November 14, 2000, and December 1, 2000. The Lawsuit was registered in 2001, but the lawyers were only served with Notices in 2011.

During the Case’s proceedings, the Lawyer’s Counsel responded by pointing out that the Lawsuit was based on a hearsay storey and that only six of the twelve Lawyers remained alive till date.

He also informed the Court that the Lawyers who are still alive have offered the Court an official apology.

“Having considered all these elements of the matter, particularly the fact that the Respondents have tendered their official apology and that they are very aged practising Lawyers, and also that Contempt Petition No.1463 of 2002 is already gotten rid  of without even issuing Notices,” the Court stated.
