Affidavit filed in Supreme Court by UP Govt for cases against sitting, Ex-MPs, MLAs

The Uttar Pradesh Government submitted an affidavit before the Supreme Court on Tuesday, in connection with cases filed or dropped against sitting and former Members of Parliament (MPs) and Members of Legislative Assembly (MLAs).

The petition asks for a direction prohibiting convicted MLAs and MPs from contesting elections for life and setting up Special Courts and speedy disposal of cases against them.

The Affidavit filed by the Amicus Curiae Vijay Hansaria before the Supreme Court stated that no “reasoned” order was passed while withdrawing these 77 cases related to Muzaffarpur Riots.

The Affidavit stated that a total of 51 MPs and 71 MLAs are allegedly involved in money laundering across India.

The Affidavit further stated that 48 out of the 71 cases pending against the MLAs are still under investigation.

While hearing a plea submitted by Counsel Ashwini Kumar Upadhyay, the Supreme Court ruled on August 10 that State Governments cannot withdraw criminal proceedings against Sitting and Former MPs and MLAs without prior Orders from State High Courts.
